1. Acceptance of these terms
These Terms of Service ("Terms") govern your access to and use of the Untapped Agents website at untappedagents.ai and the related services we offer (collectively, the "Services"). By using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. About Untapped Agents
Untapped Agents LLC ("Untapped Agents," "we," "us," or "our") is a Sacramento, California-based company that designs, deploys, and operates AI agents for businesses across intake, sales, and customer success. The website is informational and lets you request a consultation.
3. Acceptable use of the website
You agree not to:
- Use the Services in any way that violates applicable law or regulation.
- Attempt to gain unauthorized access to the Services, any related systems or networks, or any account other than your own.
- Interfere with or disrupt the integrity or performance of the Services.
- Use any automated means to scrape, harvest, or copy data from the Services without our written permission.
- Submit false, misleading, or fraudulent information (including a mobile number you do not own or are not authorized to use).
4. SMS messaging terms
By providing your mobile phone number and checking the SMS consent box on our consultation form, you expressly consent to receive recurring marketing and transactional text messages from Untapped Agents at the number provided. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply.
What you may receive
Depending on your relationship with us, messages may include marketing and promotional updates, consultation booking confirmations and reminders, onboarding and service status updates, and customer-care responses.
Opt-out and help
Reply STOP to any message to opt out. After we receive STOP, we will send you a final confirmation message and stop sending future messages. To re-subscribe later, sign up again on our consultation form. Reply HELP at any time to receive support contact information.
Carriers and delivery
The SMS program is available in the United States and supports major U.S. wireless carriers (including AT&T, T-Mobile, Verizon Wireless, Sprint, and others). Untapped Agents and the carriers are not liable for delayed or undelivered messages.
Privacy
Our handling of mobile information is described in our Privacy Policy. As stated there, no mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
5. Intellectual property
All content on the Services — including text, graphics, software, designs, and the "Untapped Agents" name and logo — is owned by or licensed to Untapped Agents and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
6. Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. ANY PROJECTIONS, BENCHMARKS, OR RESULT FIGURES PRESENTED ARE ILLUSTRATIVE AND NOT GUARANTEED.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, UNTAPPED AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).
8. Indemnification
You agree to defend, indemnify, and hold Untapped Agents and its officers, directors, employees, and agents harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your misuse of the Services.
9. Governing law & dispute resolution
These Terms are governed by the laws of the State of California, USA, without regard to its conflict of laws principles. Subject to the arbitration provisions in Section 10, any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Sacramento County, California, and you consent to the personal jurisdiction of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
10. Arbitration and class action waiver
Please read this section carefully — it affects how legal disputes between you and Untapped Agents are resolved.
Agreement to arbitrate
You and Untapped Agents agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or the relationship between us (a "Dispute") will be resolved by binding individual arbitration, except that either party may bring an individual action in small-claims court or seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property or to address unauthorized access to the Services.
Arbitration procedures
The arbitration will be administered by JAMS under its Streamlined Arbitration Rules (or another similar arbitration provider mutually agreed upon). The arbitration will be conducted in English in Sacramento County, California, unless you and Untapped Agents agree otherwise or the arbitrator determines that an in-person hearing is unnecessary. The arbitrator's award will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class action waiver
You and Untapped Agents agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If a court decides that this class action waiver is unenforceable as to a particular claim, that claim (and only that claim) will be severed and may be brought in court, while all other claims will proceed in arbitration.
Opt-out right
You may opt out of this arbitration agreement by sending written notice to Untapped Agents LLC, 2108 N ST #8823, Sacramento, CA 95816 (or by email to team@mail.untappedagents.ai) within 30 days of first agreeing to these Terms. Your notice must include your name, address, and a clear statement that you want to opt out of arbitration. Opting out will not affect any other provision of these Terms.
Time limit
Any claim or cause of action arising out of or related to the use of the Services or these Terms must be filed within one (1) year after the claim or cause of action arose, or it will be forever barred, to the maximum extent permitted by law.
11. Miscellaneous
Entire agreement
These Terms, together with our Privacy Policy and any other policies referenced here, constitute the entire agreement between you and Untapped Agents regarding the Services and supersede any prior or contemporaneous understandings.
Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it will be severed, and the remaining provisions will continue in full force and effect.
No waiver
Our failure to enforce any provision of these Terms will not be a waiver of that provision or of our right to enforce it later.
Assignment
You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or operation of law.
Force majeure
Neither party will be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, government action, labor disputes, network or power failures, or third-party service outages.
No third-party beneficiaries
These Terms do not create any third-party beneficiary rights.

Headings in these Terms are for convenience only and do not affect interpretation.

12. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top. Continued use of the Services after changes are posted constitutes your acceptance of those changes.
